How AdlerNext Learning collects, uses, stores, shares, and protects personal data.
Introduction
AdlerTech Innovations OPC Pvt. Ltd. (CIN: U72900PN2020OPC194593), having its registered office in Kagal, Kolhapur, Maharashtra, India, operates the e-learning marketplace platform under the brand AdlerNext Learning (www.adlernext.in). This Privacy Policy describes how we collect, use, store, share, and protect personal data of Learners, Instructors, and visitors in connection with the Platform.
This Policy is published in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023, as applicable.
1. Information We Collect
- Identity and contact data: name, email address, phone number, date of birth, and address.
- Account data: username, encrypted password, profile photo, and role such as Learner or Instructor.
- KYC and payout data for Instructors: PAN, GST registration, bank account, and UPI details.
- Payment data: transaction ID, payment status, and billing address. Card and banking details are processed directly by payment gateway partners and are not stored by us.
- Learning data: course enrollments, progress, assignment submissions, test scores, certificates issued, ratings, and reviews.
- Technical data: IP address, device/browser type, log data, cookies, and usage analytics.
- Communications: support tickets, emails, feedback, and grievance correspondence.
2. How We Use Your Information
- To create and manage Learner and Instructor accounts and facilitate course enrollment and delivery.
- To process payments, issue invoices, compute Platform Fees, GST, TDS, and process Instructor payouts.
- To issue Certificates of Completion under the AdlerNext Learning brand.
- To provide customer support and resolve grievances.
- To send transactional communications and, where consented, promotional or marketing communications.
- To monitor course quality, including computing learner ratings used in the Platform's quality assurance framework.
- To detect, prevent, and investigate fraud, security incidents, and policy violations.
- To comply with applicable legal, tax, and regulatory obligations.
3. Legal Basis and Consent
We process personal data on the basis of your consent at registration or enrollment, for performance of the contract, and to comply with legal obligations.
You may withdraw consent for non-essential processing, such as marketing communications, at any time through your account settings or by contacting us, without affecting the lawfulness of processing carried out before withdrawal.
4. Sharing of Information
Learner data relevant to a specific course, such as name, progress, and queries, is shared with the relevant Instructor solely for academic delivery and support. Instructors may not use this data for independent solicitation outside the Platform.
- Payment data is shared with payment gateway and banking partners strictly for transaction processing.
- We may share data with government authorities or regulators where required under applicable law, court order, or to protect rights, safety, or property.
- We may share data with service providers under contractual confidentiality obligations, solely to operate the Platform.
- We do not sell personal data to third parties for their independent marketing purposes.
5. Data Storage and Security
Personal data is stored on secure servers with industry-standard technical and organizational safeguards, including encryption, access controls, and regular security reviews.
Passwords are stored in encrypted or hashed form and are not accessible to Platform staff in plain text.
While we implement reasonable security practices, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
In the event of a data breach likely to affect Users, we shall notify affected Users and relevant authorities within the timeframe prescribed under applicable law.
6. Data Retention
Personal data is retained for as long as the User's account remains active and thereafter for a period necessary to comply with legal, tax, and regulatory record-keeping requirements, after which it is securely deleted or anonymized.
7. Cookies and Tracking Technologies
The Platform uses cookies and similar technologies to enable login sessions, remember preferences, and analyze Platform usage. Users may control cookie preferences through browser settings; disabling cookies may affect certain Platform features.
8. Your Rights
Subject to applicable law, you have the right to:
- Access and obtain a copy of the personal data we hold about you.
- Request correction of inaccurate or incomplete data.
- Request erasure of your personal data, subject to legal and regulatory retention obligations.
- Withdraw consent for optional processing activities such as marketing communications.
- Lodge a grievance with our Grievance Officer or, where applicable, the relevant data protection authority.
9. Children's Data
Where a Learner is under 18 years of age, enrollment must be completed by, and consent provided by, a parent or legal guardian, who shall be responsible for the minor's use of the Platform.
10. Changes to this Policy
We may update this Privacy Policy from time to time. Material changes will be notified through the Platform or via email, and continued use of the Platform after such notice constitutes acceptance of the revised Policy.
